Acting Chairman's Ruling

13 March 2006

Complaint 06/043

Complainant: D. Thomson

Advertisement: Vodafone New Zealand Limited

Complaint: The website advertisement at http://www.vodafone.co.nz posed the question "How is You Choose better than $10 TXT?".

Complainant, D. Thomson said one could not be better off on the You Choose plan as Telecom had 500 texts for $10, which was a better deal.

The relevant provision was the Code of Ethics, Rule 2.

The Advertiser, and its Agency, Lowe, on receipt of the complaint, acknowledged that a Vodafone customer had to purchase a voice connection before a You Choose TXT Add On, and advised that the material relating to the complaint had been removed from the website.

The Acting Chairman noted the Advertiser's and Agency's advice that the advertisements had been amended in a self-regulatory manner. Accordingly, she was of the view that the complaint had been settled and it would serve no further purpose to place the matter before the Complaints Board for consideration.

Acting Chairman's Ruling: Complaint Settled
