Chairman's Ruling

11 March 2008

Complaint 08/110

Complainant: J. Wilson
Advertisement: Vodafone New Zealand Limited

Complaint: The Southland Times newspaper advertisement for Vodafone, showed a map and made the claim:

"Vodafone works 'round here

Make the most of now".

Complainant, J. Wilson, said the advertisement was misleading with regard to the amount of coverage it claimed was available for Vodafone customers in a particular area of the map.

The relevant provision was Rule 2 of the Code of Ethics.

The Chairman noted the issue of concern to Complainant, J. Wilson. However, he said the map was purely a general indication of the coverage area for Vodafone, and there were always "blind spots" in all locations. This, the Chairman said, did not make the advertisement misleading to the consumer and accordingly, there was no apparent breach of the Advertising Codes.

The Chairman ruled there were no grounds for the complaint to proceed.
