Complainant: S. Hood

Advertisement: Vodafone New Zealand Limited



Complaint: The Vodafone website advertisement offered a Home Phone Plus package with "Unlimited local and national calling".



Complainant, S. Hood, said the advertisement was misleading as it implied that this was a landline based connection when in fact it was a service through their mobile network, which was not as good as it involved difficulties with "coverage, quality and reliability".



The relevant provision was Rule 2 of the Code of Ethics.



The Chairman noted S. Hood's view. However, he said the More Information section of the advertisement said: "When you sign up to home phone plus you get an at home box for $99*, saving you $100. Your at home box contains a SIM card, which gives you access to the Vodafone network. You just plug your phone into the at home box and you are ready to go." Accordingly, he said the offer was explained, the advertisement was not misleading, and there was no apparent breach of Rule 2 of the Code of Ethics.


The Chairman ruled there were no grounds for the complaint to proceed.
