Advertisement: Vodafone New Zealand Limited
Complaint: The First Mobile advertisement for Handsfree Mobiles featured in the Bestbuys catalogue. At the bottom of the page it said: "See Us first for safe driving."
Complainant, A. Lambert, was of the view that the advertisement was misleading as it was not completely safe to us a Handsfree Mobile while driving.
The relevant provisions were Basic Principle 4 and Rules 2 and 12 of the Code of Ethics.
The Advertiser, Vodafone New Zealand Limited, said: "We can assure the Authority the Vodafone and First Mobile welcome the new legislation as a positive step in improving road safety, that we are aware of the danger of using hands-free kits while driving, and that we are actively communicating that danger to our customers. This advertisement will not be repeated."
The Chairman noted the comments received from the Advertiser and the self-regulatory action taken by the Advertiser to not repeat the advertisement. Accordingly, she said the matter was settled and it would serve no further purpose to place it before the Complaints Board.
The Chairman ruled that the complaint was settled.
