Advertisement: Vodafone New Zealand Ltd
Complaint: The website advertisement was headed "Get the best plan for you. Compare plans - Vodafone NZ". The consumer was required to complete the line: "I am happy about spending --- per month", select from a range of there variable conditions and the preferred term for the plan.
Complainant, F. Edwards, said although the "On Account" plans shown told what was included for the monthly charges, "There isn't any mention of what the charges for calls and texts over the plans allotment." In the Complainant's view this information should have been included in the advertisement.
The relevant provision was Rule 2 of the Code of Ethics.
The Chairman noted F. Edwards' concern about the advertisement, which he felt was misleading by omission. The Chairman noted that the advertisement focused on offering a selection of plans for the consumer to choose the most suitable one for their needs and requirements, and not the penalties incurred if a plan was exceeded. In her view, the query raised by F. Edwards could be directed to the Advertiser for response prior to selection of a plan. Accordingly, the Chairman said the advertisement was not likely to mislead or deceive consumers by omission and there was no apparent breach of Rule 2 of the Code of Ethics.
The Chairman ruled that there were no grounds to proceed.
