Complainant: M. Collier
Advertisement: Vodafone New Zealand Ltd

Complaint: The text message advertisement was sent to a Telecom customer and said "Switch 2 our reliable network, bring yr number to Vodafone & we'll cover any termination fees as a credit & give u a FREE mobile. Reply-TXT CALL to discuss".


Complainant, M. Collier, was of view that the advertisement was misleading as it did not say that in order to take up the offer you needed to sign up for a 24 month plan.


The relevant provision was Rule 2 of the Code of Ethics.


The Chairman noted M. Collier's concerns about the advertisement. However turning to the advertisement, she noted that it presented an offer to Telecom customers in an informal, brief, and direct way, and invited them to contact Vodafone to discuss the offer further, where she said that the full details of the offer would be clarified, including any conditions related to the offer. She commented that an offer of a free cell-phone on the condition that the customer signed up to a calling plan was a common offer within the telecommunications market. The Chairman was of the view that the advertisement was not in apparent breach of Rule 2 of the Code of Ethics, and accordingly ruled that there were no grounds for the complaint to proceed.
