Advertisement: Bumble Enterprises
Complaint: The website advertisement for Bumble Enterprises Detox Foot Pads as featured on http://www.bumbleenterprises.co.nz stated the following words:
"Detox & Purify your body ... while you sleep!!
"Our bodies don't know how to handle all the toxins, and don't know how to get rid of them via the normal detoxification measures. Over a period of time these substances accumulate and will cause various debilitating and chronic conditions."
Complainant, M. Edwards, said: "The advertisement claims that these foot pads "cleanse your system while you sleep." There is no scientific evidence to support this claim and these foot pads have been shown to be of dubious value by investigations overseas. The advertisement also plays on peoples fears and lack of knowledge by talking about the build up of toxins, for example "Our bodies don't know how to handle all the toxins, and don't know how to get rid of them via the normal detoxification measures. Over a period of time these substances accumulate and will cause various debilitating and chronic conditions." Such a claim is not supported by the scientific literature, particularly when they state that "they WILL cause" various conditions".
The relevant provisions were Principles 2 and 3 and Part B1 Requirements 4, 4(a), 4(b) and 4 (c) of the Therapeutic Products Advertising Code.
The Advertiser, Bumble Enterprises, said: "Thank you for your email, which I was very surprised to receive as I had no idea that any of my website was against the Advertising Codes. The information about the foot pads was copied from the brochure that I am supplied with by my supplier...I have just gone back through the webpage in question and made changes..."
The Chairman noted the explanation from the Advertiser and that steps had been taken to change the website content. The Chairman, noting this self-regulatory action, said that it would serve no further purpose to place the matter before the Complaints Board. The Chairman ruled that the matter was settled.
