COMPLAINT NUMBER 17/010
COMPLAINANT K Weggery ADVERTISER Rodd & Gunn ADVERTISEMENT Rodd & Gunn Addressed Mail DATE OF MEETING 25 January 2017
Advertisement: The addressed email advertisement for a half-price sale included the
words "All shirts 1/2 price".
The Chair ruled the complaint was Settled.
Complainant, K Weggery, said: "I believe the adverts clearly state that all Shirts are 50%. At the store we were advised that t Shirts polo shirts are not included. I believe this advertising campaign is deliberately mis leading."
The relevant provisions were Code of Ethics - Basic Principle 4, Rule 2.
The Chair noted the Complainant's concerns the half-price sale for "all shirts" did not apply to polo shirts.
The Chair acknowledged the response from the Advertiser, who said the issue that has been raised is a case of terminology. The Advertiser said when they refer to "shirts", as distinct from polos and tee shirts, they mean shirts that are woven and have a collar.
The Advertiser said that in the interest of clarity for all consumers, "all of our future category offers will be specific and contain a disclaimer stating what categories do not apply to the offer."
The Advertiser also offered a sincere apology to the Complainant for any inconvenience caused.
Noting the explanation provided, the apology and the Advertiser's commitment to amend future advertisements, the Chair said that it would serve no further purpose to place the matter before the Complaints Board. The Chair ruled that the matter was settled.
