Advertisement: The Firstin website, http://www.firstin.co.nz, digital advertisement for the product Anti Press Fidget Spinner. The features & specifications for this product claim it is "designed to relieve stress, anxiety, ADD & ADHD, Autism. Helps you stay focused."
The Chair ruled the complaint was Settled.
Complainant, M Honeychurch, said: The First In advert for Fidget Spinners talks of them being "Designed to relieve Stress, Anxiety, ADD & ADHD, Autism". This appears to be a therapeutic claim, and would make the advert come under the ASA's "Therapeutic and Health Advertising Code".
The claim that a fidget spinner has been designed to relieve these medical conditions is likely to lead parents of children with these conditions to believe that it is able to help. This
advert therefore breaches Principle 2 of the code. It also breaches Rule 2(a) of the code, as
these claims have not been substantiated.
The relevant provisions were Therapeutic and Health Advertising Code - Guideline
2(a), Principle 1, Principle 2.
The Chair noted the Complainant's concern that the advertisement makes unsubstantiated
claims about the benefits of using a Fidget Spinner, which are misleading.
The Chair acknowledged Firstin had made changes to the website, removing or amending references which were of concern.
Given the Advertiser's co-operative engagement with the process and the self-regulatory action taken in amending the website, the Chair said that it would serve no further purpose to place the matter before the Complaints Board. The Chair ruled that the matter was settled.
