COMPLAINT NUMBER 17/199

COMPLAINANT C Price

ADVERTISER Vitaco Health (NZ) Ltd ADVERTISEMENT Vitaco Health (NZ) Ltd, Television DATE OF MEETING 18 July 2017

OUTCOME Settled

Advertisement: The Nutra-Life NZ television advertisement for Ester C vitamins said..."Winter's here, so what can we all do to maintain a strong and balanced immune system this season? Is there a way to get 24 hour immune support? The answer is yes! New Nutra-Life Ester-C advanced immune, the only 24 hour Vitamin C with the natural power of olive leaf, garlic & Zinc..."

The Acting Chair ruled the complaint was Settled.

Complainant, C Price, said: The advertisement stats that the new advanced ester c is the only 24 hour vitamin c on the market.

This is incorrect as there are multiple 24 hour vitamin c in the market, they are just not called

ester c

I think this is false advertising and misleading to consumers

The relevant provisions were Therapeutic and Health Advertising Code - Guideline

2(a), Principle 1, Principle 2.

The Acting Chair noted the Complainant's concern that the advertisement contained misleading claims about being the only 24 hour Vitamin C product on the market.

The Acting Chair noted that the Advertiser had altered the advertisement to remove all references to the word 'only'.

Given the Advertiser's co-operative engagement with the process and the self-regulatory action taken in amending the advertisement, the Acting Chair said that it would serve no further purpose to place the matter before the Complaints Board. The Acting Chair ruled that the matter was settled.
