Advertisement: The Mike Pero television advertisement shows Mike Pero riding a motorcycle around various locations in New Zealand, including small coastal roads where he appears to ride on the wrong side of an unmarked road.

The Chair ruled there were no grounds for the complaint to proceed.

Complainant, K.Beach, said: During the ad Mike Pero is riding a Triumph Motor cycle, and approximate one third the way through the ad it is seen that he rides on the wrong side of the road on a blind corner.

The relevant provisions were Code of Ethics - Basic Principle 4, Rule 12.

The Chair noted the Complainant's concern that the bike in the advertisement crosses over

to the wrong side of an unmarked road on a blind corner.

The Chair acknowledged that, while not ideal, the image was a fleeting part of the overall advertisement. The Chair noted that wherever road markings existed the motorcycle had clearly stayed on the correct side and it was on a narrow stretch of an unmarked road where it was more debatable exactly where the centre line would be.

The Chair's view was that the advertisement was not promoting the motorcycle or commenting on its performance in any way and therefore would be unlikely to encourage a disregard for safety. The Chair said the advertisement did not reach the threshold to breach the Code of Ethics.

Accordingly, the Chair ruled there were no grounds for the complaint to proceed.
